Other Commercial General Liability Insurance Related Products & Optional Coverages Descriptions:


Care, Custody and Control Liability Insurance [CCC] (an endorsement or a mono-line policy)

[GENERAL INFORMATION ONLY]  This coverage protects Owner / Operators who engage in the business of having horses in their care, custody and control, that are not owned by them but are owned by third parties, from the cost of damages and legal defense if a non-owned horse becomes sick, is injured or dies and the owner attempts to hold them legally responsible and / or if it is determined that the insured is legally obligated for the loss (claim).  This type of insurance is usually added by endorsement onto the Commercial General Liability [GL] Policy, but it may also be placed as a separate mono-line policy. It is usually offered to operators when they qualify for it and have requested a quote for it on their GL application.

TO APPLY:  When completing your GL application, complete the questions concerning Care, Custody and Control Liability to the affirmative and a quote will be provided as an optional coverage with your GL Premium Indication.  To apply for a separate (mono-line) CCC policy, you will need only to complete a few pages of the GL application that apply to you.


Professional Liability (an endorsement)

[GENERAL INFORMATION ONLY]  This insurance covers equine / equestrian professionals for sums the insured becomes legally obligated to pay as damages due to bodily injury, property damage, personal injury, prize money losses, or loss of value to a horse, to which this coverage part applies caused by a “professional incident” relating to the insured’s errors and omissions in personal professional judgment. This type of insurance may only be added by endorsement onto a Commercial General Liability [GL] Policy and may not be placed as a separate mono-line policy. It is usually offered to operators when they qualify for it and have requested a quote for it on their GL application.

TO APPLY:  When completing your GL application, complete the questions concerning Professional Liability to the affirmative and a quote will be provided as an optional coverage with your GL Premium Indication.


Employee Benefit Liability (an endorsement)

[GENERAL INFORMATION ONLY]  This insurance provides coverage for errors or omissions by the insured in the administration of the insured’s employee benefits plan.  It does not include coverage for liabilities arising out of the statutory obligations created by the Employee Retirement Income Security Act (ERISA).  This type of insurance may only be added by endorsement onto a Commercial General Liability [GL] Policy and may not be placed as a separate mono-line policy. It is usually offered to operators when they qualify for it and have requested a quote for it on their GL application.

TO APPLY:  When completing your GL application, complete the question concerning Employee Benefit Liability to the affirmative and a quote will be provided as an optional coverage with your GL Premium Indication.


Hired and Nonowned Automobile Liability  (an endorsement)

[GENERAL INFORMATION ONLY]  This insurance provides coverage for the policyholder against liability incurred while driving an automobile not owned or hired by the policyholder or resulting from the use of someone else’s automobile on the insured’s behalf, such as an employee using a personal car for the employer’s business purposes.  This type of insurance may only be added by endorsement onto a Commercial General Liability [GL] Policy and may not be placed as a separate mono-line policy. It is usually offered to operators when they qualify for it and have requested a quote for it on their GL application.Clubs and Associations, especially, should give this type of insurance careful consideration because of a club or association’s potential lack of auto insurance.

TO APPLY:  When completing your GL application, complete the question concerning Hired and Nonowned Automobile Liability to the affirmative and a quote will be provided as an optional coverage with your GL Premium Indication.


Personal Accident Insurance (a mono-line policy)

[GENERAL INFORMATION ONLY]  This coverage is a form of medical expense coverage for people participating in the following Insured sponsored horse related activities:  Riding Instruction, Pony Rides, Hourly Horse Rentals, Guides & Outfitters, Horse Drawn Vehicle Rides, Horse Related Camps, Dude Ranches, Horse Related Guest Ranches, and Horsemen’s Club or Association.  This coverage would be a secondary type of coverage.  The participant’s own Accident Medical Insurance would be PRIMARY.  Coverage excludes injuries to riders while hunting, racing on horseback, or participating in rodeos.  Personal Accident Insurance is placed as a separate policy and is not part of a Commercial General Liability [GL] Policy.  It is usually offered to operators and clubs when they qualify for it. 

TO APPLY:  Information will be taken from your GL application and a quote will be provided for Personal Accident Insuranceas an optional coverage in conjunction with your GL Premium Indication.


Directors & Officers Liability [D & O]  (a mono-line policy)

[GENERAL INFORMATION ONLY]  This is a form of Professional Liability Insurance to cover the Directors and Officers of a corporation for mistakes in administering their duties as such, primarily in relation to a money damage claim for a wrongful act – i.e. mismanagement of funds, decision making disputes, etc. Available for both profit and non-profit Companies and Organizations.  D & O Insurance does not provide Bodily Injury and Property Damage Coverage.  D & O Insurance does not replace or negate the need for the Insured’s need for a General Liability Policy.  Directors & Officers Liability Insurance is placed as a separate policy and is not part of a Commercial General Liability [GL] Policy.  It is only offered to operators and clubs when they have requested a quotation for it and qualify for it per their completed application.

TO APPLY:  Please call, fax or e-mail an Ark Agency Representative.  Upon request, we will send you a packet of information, an application, and instructions.  The Insurer will require a fully completed application for insurance signed by the president of the organization and copy of its most recent financial statement.  Once approved by the Insurer a quote will be provided to you for Directors & Officers Liability.
