EQUINE LIABILITY INSURANCE THROUGH NAHA AND HNA RISK PURCHSING GROUP:  
Insure Your Horse Activities for Liability

[GENERAL INFORMATION ONLY]  Commercial General Liability Insurance [GL] protects you when you become legally obligated to pay sums as damages because of “bodily injury” or “property damage” occurring in relation to your insured business activities as stated in your liability insurance policy.  In the event of such an occurrence, the Insurer has the right and duty to defend any “suit” seeking those damages, whether groundless or substantial.  And the Insurer may at its discretion investigate any “occurrence” and settle any claim or “suit” that may result, up to the limits of and within the scope of your insurance policy.  As third party coverage, this type of insurance does not pay the named insured or his or her family members for damages or injuries they may incur.  This type of insurance also does not pay for the damages or injuries incurred by employees, contract laborers, exchange laborers, and volunteers working on your behalf.  Worker Compensation and Employer’s Liability Insurance are not part of a general liability policy.

The NAHA Equine Liability Program is a Safety Control and Risk Reduction Program.  Therefore, all those insured under the program must review and [agree to] comply with the Mandatory NAHA Standards of Operation.  All Insureds must become members of NAHA and HNARPG and participate in the risk reduction support program.  When applying for insurance you must be pre-qualified and can then request a copy of the appropriate Risk Reduction Program that applies to your operations.  The Risk Reduction Programs are not available on this web site.  We will fax, mail, or e-mail them to you and they will be included in your membership kit.

FARM LIABILITY

If you raise plants, crops or farm animals to sell or for personal use, you likely have a farming exposure. If you cannot insure this exposure under your property insurance policy, it may be possible to add it to your Commercial General Liability Policy.

DEDUCTIBLE: None

PREMIUM FINANCING:  Available on most policies.  Not available on seasonal risks.

LOSS CONTROL: This is a safety control / risk reduction program, therefore all risks are required to follow a risk reduction program that is mandated and provided by the North American Horsemen’s Association.

AVAILABILITY: All States;  Insurance for special risks may not be available in some areas and some states.

EXCLUSIONS AND RESTRICTIONS: Some exclusions and restrictions apply.   

SEVERAL COMMON EXCLUSIONS CONTAINED IN THE GENERAL LIABILITY POLICY:

  • Medical Payments to Members Exclusion (Applies to Clubs and Associations)
  • Firearms Possession, Maintenance or Use Exclusion  (Applies to most policies, but usually to certain clubs and some guides & outfitters)
  • Law Enforcement Activities Exclusion   (Applies to most policies, but usually to certain clubs and mounted patrol units)
  • Rodeo Participation Exclusion (Usually applies to sponsors, promoters and managers of  rodeos)
  • Unguided Trail Ride Exclusion  (This program does not insure Unguided Trail Ride Operations)
  • Double Riding Exclusion (Applies to all policies.  Refers to two or more “riders” on the same “horse”)
  • Riders Strapped or Secured onto Saddle or “Horse” Exclusion  (Applies to all policies.)
  • Mandatory Equestrian Protective Headgear Use by Riders Age 15 and Younger Exclusion (Applies to operators of Equestrian (riding) Services)
  • Barbed Wire and Single-Strand Fencing Exclusion  (Applies to all policies)
  • Employee or Volunteer Bodily Injury Exclusion  (Applies to all policies)
  • Canine Exclusion (Applies to all policies.  Dogs should be insured under the owner’s Personal Liability Insurance)
  • Liquor Liability Exclusion (Applies to all policies)

Coverages, Limits, and Policy Conditions vary from one policy to another, depending upon the activities insured and limits chosen.

TO APPLY:  Call an Ark Agency Representative for information about how to apply for insurance and to pre-qualify your operations and activities.  We can help you determine which application and risk reduction programs you should use; however information is provided under Applications on this site.  All equine liability applications are posted on this site.  However, risk reduction programs are not and we will send the correct one to you by e-mail, fax, or mail.  You will be required to complete an application for insurance, review and sign a risk reduction program and provide some photos for underwriter’s review.  Once approved, we will provide a Premium Indication to you.
